The Callus

Your Honor, I understand the oath. I understand what perjury is. I understand that nothing I am about to say is going to make my situation better, and I am going to say it anyway, because my lawyer has resigned and because I am tired.

My name is Daniel Ovitz. I am forty-one. I was, until three weeks ago, the Chief Marketing Officer and co-founder of a company called Aftermemory. My partner, Dr. Emil Vestergaard, is dead. I did not kill him. I did not dispose of his body. There is no body to dispose of, and I am going to tell you why.

I met Emil at a conference in Zurich in 2029. I was there to sell people on a personalization engine that did not work. He was there because someone had invited him to keynote on decoherence in superconducting qubits, and he had accepted, apparently, because the venue was walking distance from a chocolate shop he liked. He talked for forty minutes about phase noise. He lost the room in the first three. I bought him a drink afterward because I had seen the CFO of a Series B fintech pretend to take notes and I wanted to know how a man could produce that effect on a room full of adults.

I want the record to reflect that I am, in my chosen profession, dishonest. I sell things that are not quite true to people who mostly know better. I have been doing this since I was nineteen. It is the only skill I have and I am, within its narrow band, very good at it. I say this because in a moment I am going to describe something that sounds like a lie, and I want it noted that I know what a lie sounds like.

Aftermemory was Emil's idea. Not mine. He came to me six months after Zurich with a hundred pages of math and a demo running on a rented quantum machine in Delft. The pitch was simple enough that even I understood it. Grief is a memory reconstruction problem. The brain is bad at it. You want to sit with your dead mother one more time and you cannot, because your memory of her has degraded and the sitting requires a body she no longer has. Emil said, in his flat Danish way, that both problems were tractable. The degradation could be corrected by cross-referencing photographs, video, voice recordings, and the sworn testimony of surviving relatives. The body could be simulated in VR. The novel part, the part he had come to me for, was that the simulation would be run on a quantum computer using a technique he called retro-coherent sampling. I did not understand it. I still do not. What I understood was that on his rented machine in Delft I put on a headset and I sat across from my father, who had died when I was twelve, and he said the thing he used to say when I brought home a bad grade, which was, "Well, Danny, we cannot all be Einstein," and I cried into a stranger's headset for eleven minutes and I signed the term sheet on the plane home.

I raised Aftermemory's Series A in three weeks. Twenty-eight million dollars at a valuation I will not embarrass myself by repeating. I hired a growth team, a policy team, and a bioethicist because our lead investor said we needed one, and I fired her four months later because she kept using the phrase "consent of the deceased," which was not going to appear in any pitch deck I would ever build. We took delivery of our own quantum machine, a three-thousand-qubit unit from a vendor in Grenoble whose name I am under NDA not to mention and will therefore not, in a courtroom, under oath, mention. We installed it in a data center outside Reno because the power was cheap, the humidity was low, and the regulations were, at that time, ambiguous.

We sold the service for twelve thousand dollars a session. We had a waiting list of six thousand people within a year.

I want to be careful here. I want the jury to understand what we were actually doing, because the prosecution has been describing it as a VR company, and that is what we told our customers, and that is what we told the SEC, and it was not, technically, what we were doing.

Emil's technique did not simulate the dead. It sampled them.

I am going to say that again because I did not understand it for nine months. The quantum machine did not run a model of your dead mother. It ran a search. It searched, using the customer's memories as a boundary condition, for a configuration of the wavefunction of the universe consistent with those memories. When it found one, it rendered that configuration from the inside of the customer's headset. The customer was not visiting a simulation. The customer was, in a limited and heavily filtered sense, sampling a real slice of the past.

Emil told me this in the parking lot of the Reno data center in the summer of 2031. I laughed. I asked him if he wanted a raise. He said no. He said the sampling was leaving a residue, that the wavefunction did not like being sampled and was, in his phrase, developing a callus. He said we needed to stop selling sessions until he understood what the callus was doing.

I did not stop selling sessions. Emil asked me to and I did not. We had a Series B closing in November and I told him we would slow down after the round closed. He did not argue. He was not the kind of man who argued. He went back to Reno and started working nights and I did not ask him what he was doing because I did not want to know.

He called me on the fourteenth of March. He said he needed me at the data center. He said he had figured out what the callus was and needed a witness who was not a physicist, because the board would want a non-physicist's account, and I was the least physicist person he could think of. I flew to Reno the same night. I want the record to reflect that I went willingly, and that if I had known what I was going to see, I would have gone anyway, because marketing people go toward the thing that is happening.

The data center at Reno is a room the size of a basketball court. The quantum unit sits in a shielded chamber in the middle, refrigerated to eleven millikelvin, surrounded by a walkway. Emil was on the walkway when I arrived, in his usual sweater, drinking coffee from a mug that said, in his daughter's handwriting, WORLD'S OKAY DAD. He looked, I thought at the time, tired. He looked, in retrospect, like a man about to be proven right.

He walked me through what he had found. The retro-coherent sampling was not, as we had told investors, a passive read of the wavefunction. It was a query, and queries at that energy scale had a back-reaction. Every session we ran had opened, and closed, a small aperture between the present configuration of the wavefunction and the configuration being sampled. The apertures were, individually, harmless. Cumulatively, they had thinned something. He used the word fabric. I remember thinking it was an unusually literary word for him. He said the fabric was thin in one specific place in the chamber and he was going to reinforce it with a corrective sampling protocol he had written the previous night. He said the protocol had a ninety-two percent chance of working. He said the remaining eight percent was interesting.

I asked him to define interesting. He smiled. He said he would tell me afterward.

He initialized the protocol at 03:47 local time. I was standing behind him, about four meters back, near the safety rail. The chamber began to hum, which was normal. The lights on the qubit array shifted from blue to a color I had not seen them make before, which was not normal. Emil said, without turning around, "Ah." He said it the way he said it when a graph came out the way he expected. He said it the way you say it when you have understood something and there is no time left to explain it.

The air in the chamber, in a region about two meters across, began to shimmer. I do not have a better word. It looked like a heat mirage on a highway, except vertical, and the shimmer had an edge, and inside the edge the light was doing something the light in the rest of the room was not doing. Emil said, still without turning around, "Daniel. Step back."

I stepped back. I want the record to reflect that this is the only order he ever gave me in seven years of partnership, and I obeyed it.

The shimmer opened. It did not tear, and it did not rip, though those are the words the tabloids have used. It opened, the way an aperture on a camera opens, in a smooth iris motion, and on the other side of it was a landscape I did not recognize, full of a light that was too yellow, and standing in the landscape, about six meters from the aperture on its side, was an animal.

I am going to describe the animal because the prosecution has spent three weeks suggesting that I am making it up, and I want to be specific enough that a paleontologist can, at the appropriate time, tell you whether I am.

It was about four meters long from nose to tail. It stood on two legs. Its head was the size of a microwave oven. Its forelimbs were short and held close to its chest in a way that looked, to me, almost apologetic. Its skin was not green. It was a mottled brown with darker stripes across the flanks, and there were feathers, or something like feathers, along the ridge of its back and around the base of its skull. Its eyes were forward-facing and yellow. It was breathing. I could see its ribcage moving.

It looked at Emil. Emil looked at it. Neither of them moved for what I want to say was a long time and what was probably two seconds. Then Emil turned his head, very slightly, toward me, and he said, in the same flat voice he used for phase noise, "Daniel. Tell my daughter I love her."

The animal covered the distance between them in one movement. I did not see the movement. I saw Emil standing on the walkway and then I saw the animal where Emil had been standing and I saw Emil's coffee mug on the walkway, unbroken, and I did not see Emil.

The aperture closed. It closed the way it had opened, in a smooth iris motion, and when it was closed the air in the chamber was quiet again and the qubit array had returned to blue and the room was exactly as it had been at 03:46, except that Emil was not in it, and neither was the animal, and the mug that said WORLD'S OKAY DAD was on the walkway where he had dropped it, which I picked up, because I did not know what else to do, and which I carried out of the data center, and which the Washoe County Sheriff's Department has entered into evidence as Exhibit 14.

There is no body. There is no body because there is no Emil in this configuration of the wavefunction anymore. He is in the configuration on the other side of the aperture, which closed at 03:47 on the fourteenth of March, and which, according to the corrective protocol he was running, cannot be reopened, because reopening it would require the fabric he was trying to reinforce, and the reinforcement worked. The protocol succeeded. The ninety-two percent case obtained. The interesting eight percent is what took him.

I know how this sounds. I have spent my career making things sound like other things and I am telling you, under oath, that I am not doing that now. I am a con man. I conned twenty-eight million dollars out of a fund that should have known better, and I conned six thousand people into believing they were visiting their dead when they were, in a way I still do not fully understand, doing something considerably stranger. I have conned better juries than this one. If I were lying to you, I would be telling you a better lie.

The prosecution has asked, reasonably, why I did not report Emil's death immediately. I did not report it because I did not, in the first hours, believe it. I sat in the data center parking lot until sunrise holding a coffee mug and tried to convince myself I had had a stroke. I had not. I drove back to the hotel, opened Emil's laptop, and read the protocol he had run and the paper he had drafted for Physical Review D and not submitted, and I understood, to the limit of my ability to understand anything he wrote, what had happened. Then I called our general counsel and said Emil is missing, because I did not know how else to say it. That was the first lie I told about the fourteenth of March, and everything I have said in this courtroom since has been an attempt to walk it back.

I am willing to be convicted of fraud. I committed fraud. I sold a service whose mechanism I misrepresented and I took money from grieving people and I would like the court, when sentencing, to consider that I understand this and that I will not contest it.

I am not willing to be convicted of murdering Emil Vestergaard. I did not murder him. I loved him, in the way marketing people are permitted to love physicists, which is to say I loved him from a safe distance and I let him do his work and I sold the results and I did not, when he asked me to stop, stop. That is what I did to him. That is the harm I did. It is a real harm and it is not the harm the prosecution has charged me with.

The paper is on his laptop. The laptop is in evidence. Any physicist the court appoints can read it. I ask only that the physicist be given time, and that the court accept that the eight percent case, when it obtains, looks like a murder and is not one.

I have nothing else to say. I would like to sit down. I would like, if the bailiff permits, to keep the mug.
